Terms and Conditions — Quick Pick (Pvt) Ltd

These Terms and Conditions ("Terms") govern your access to and use of the Quick Pick platform, including our website, mobile applications, and related services (collectively, the "Platform"). The Platform is operated by Quick Pick (Pvt) Ltd.

By accessing, registering for, or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Definitions

  • Customer: a user who places orders or requests services through the Platform.
  • Merchant / Restaurant / Store: a third-party business offering goods or services through the Platform.
  • Driver: an independent third-party service provider who may accept delivery or service requests via the Platform.
  • Order: a request by a Customer to purchase goods from a Merchant through the Platform for delivery.
  • Wallet / Ledger: internal records used to track payable amounts and payouts to Merchants and Drivers.

2. Platform Role

Quick Pick is a technology platform that connects Customers with Merchants and independent Drivers.

  • Merchants are responsible for the quality, preparation, packaging, safety, legality, and accuracy of goods they provide.
  • Drivers are responsible for delivery performance and compliance with road, safety, and legal requirements.
  • Quick Pick does not manufacture, prepare, or store products sold by Merchants unless explicitly stated.

3. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent that you have the right and capacity to enter into these Terms.

4. User Accounts and Security

  • You must provide accurate and current information when registering.
  • You are responsible for maintaining confidentiality of your login credentials.
  • You are responsible for all activity under your account.
  • You must notify us immediately if you suspect unauthorized access.
  • We may suspend or terminate accounts for security reasons, suspected fraud, or Terms violations.

5. Customer Terms

5.1 Ordering and Acceptance

Orders are subject to:

  • Merchant acceptance and availability,
  • item availability,
  • Driver availability (where delivery is required).

5.2 Pricing

Prices shown on the Platform may differ from in-store prices. Some items may be substituted or canceled if out of stock (depending on Merchant policy and Platform settings).

5.3 Delivery Estimates

Delivery times are estimates and may be affected by traffic, weather, Merchant preparation times, and Driver availability.

5.4 Customer Responsibilities

Customers must ensure:

  • correct delivery address and contact information,
  • availability to receive delivery,
  • safe and lawful behavior toward Merchants and Drivers.

6. Merchant (Restaurant/Store) Terms

Merchants agree to:

  • maintain accurate menus, prices, and availability,
  • ensure safe, hygienic, and compliant preparation and packaging,
  • handle allergens responsibly and provide accurate descriptions where applicable.

6.1 Payouts

Quick Pick may process customer payments and track amounts payable to Merchants using internal wallet/ledger records. Payout timing and deductions (if any) follow separate commercial agreements between Quick Pick and the Merchant.

7. Driver Terms

7.1 Independent Contractor Status

Drivers are independent contractors and not employees of Quick Pick (Pvt) Ltd.

7.2 Service Standards

Drivers must:

  • comply with traffic laws,
  • handle orders responsibly,
  • maintain respectful conduct,
  • follow safety guidelines.

8. Payments, Fees, and Wallet System

8.1 Payments

Customers pay using supported online payment methods through secure third-party payment processors.

8.2 Fees

Delivery fees and any applicable charges are shown before confirming the order/payment.

8.3 Wallet/Ledger

Quick Pick may maintain internal wallet/ledger records to track:

  • earnings,
  • payouts,
  • adjustments,
  • transaction references.

Wallet balances are internal records and may be subject to verification, disputes, chargebacks, fraud checks, and compliance requirements.

9. Missing Delivery Responsibility Clarification

If an order is marked "Delivered" but the Customer claims it was not received, Quick Pick may investigate using available information such as:

  • delivery confirmation steps,
  • GPS/location data
  • call/chat logs,
  • Merchant/Driver statements,
  • photos or other evidence.

Refunds/credits are not automatic and are decided based on investigation results, fairness, and applicable Sri Lankan law.

10. Prohibited Conduct

You agree not to:

  • use the Platform for illegal activities,
  • commit fraud or abuse refunds/chargebacks,
  • harass or threaten other users,
  • interfere with Platform operations or attempt unauthorized access.

11. Intellectual Property

All Platform content (logos, branding, text, software, UI) is owned by Quick Pick (Pvt) Ltd or its licensors and protected by intellectual property laws. Unauthorized use is prohibited.

12. Suspension and Termination

We may suspend/terminate access if we reasonably believe:

  • you violated these Terms,
  • your account is involved in fraud/abuse,
  • suspension is needed for safety, security, or legal compliance.

13. Disclaimer of Warranties

The Platform is provided "as is" and "as available." We do not guarantee uninterrupted availability or error-free operation.

14. Limitation of Liability

To the maximum extent permitted under Sri Lankan law, Quick Pick (Pvt) Ltd is not liable for indirect or consequential damages arising from use of the Platform, including issues caused by Merchants or Drivers.

15. Changes to Terms

We may update these Terms at any time. Updated Terms take effect when posted. Continued use indicates acceptance.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Courts of Sri Lanka will have jurisdiction, subject to applicable consumer protection laws.
